Terms of Service

Article 1. Purpose

These Terms of Service ("Terms") govern access to and use of the Prospectyx platform (prospectyx.com), published by Prospectyx SAS. By creating an account, you unconditionally accept these Terms.

Article 2. Access to the service

Prospectyx is accessible to professionals and businesses. Registration is reserved for adults acting in the context of their professional activity.

A free 7-day trial is offered with no commitment or credit card required. After the trial period, access to features is conditional on subscribing to a paid plan.

Article 3. Pricing plans

• Starter — €39/month excl. tax: 300 leads, 1,000 emails, 1 SMTP
• Growth — €99/month excl. tax: 2,000 leads, 5,000 emails, 3 SMTP, autonomous agent
• Agency — €249/month excl. tax: Unlimited, unlimited SMTP, multi-accounts

Prices are exclusive of tax. Applicable VAT is charged in addition according to current regulations. Subscriptions renew automatically each month. Cancellation can be made at any time from settings, with no fees or notice, with access until the end of the paid period.

Article 4. User obligations

The user agrees to:

• Use the service only for lawful professional B2B prospecting
• Not prospect individuals (B2C) without explicit consent
• Comply with GDPR and applicable data protection laws
• Include a valid unsubscribe link in every prospecting email
• Honor all unsubscribe requests immediately
• Not use the service to send spam or unsolicited communications to individuals
• Not attempt to circumvent technical limits of the service
• Not share login credentials

Article 5. Intellectual property

Prospectyx SAS owns all intellectual property rights relating to the platform (code, design, AI algorithms, brand). Any reproduction without express authorization is prohibited.

Data imported by the user (leads, sequences) remains their property. Prospectyx processes it only to provide the service, in accordance with the privacy policy.

Article 6. Limitation of liability

Prospectyx undertakes to provide the service with the care of a diligent professional. However, we do not guarantee specific results (response rates, number of meetings obtained).

Prospectyx's liability is limited to the amounts paid during the 3 months preceding the alleged damage. Prospectyx is not liable for indirect or consequential damages.

The user is solely responsible for the content of emails sent via the platform and for compliance with applicable regulations governing their prospecting.

Article 7. GDPR compliance and B2B prospecting

Email prospecting to professional contacts (B2B) is legal under GDPR provided that:

• The email is professional (linked to the role, not personal)
• The message is related to the recipient's position or activity
• Each email contains a functional unsubscribe link
• Unsubscribes are honored immediately

Prospectyx provides the tools to comply with these obligations. The user remains responsible.

Article 8. Suspension and termination

Prospectyx reserves the right to suspend or terminate any account in case of violation of these Terms, abusive use (spam, phishing), or non-payment after a 7-day grace period.

Upon termination, the user may export their data for 30 days following account closure.

Article 9. Modification of Terms

Prospectyx may modify these Terms. In case of material change, active users are notified by email 30 days before the effective date. Continued use of the service after that date constitutes acceptance of the new Terms.

Article 10. Applicable law

These Terms are governed by French law. In case of dispute, the parties will endeavor to find an amicable solution. Failing that, the courts of Paris shall have sole jurisdiction.
